The primary aim of the 2004 Traffic Management Act, which is to give local authorities both the duty to and the tools to do everything reasonably possible to expedite the free flow of traffic, seems at first sight relatively straightforward. But the devil is, as usual, in the detail, and certain aspects of the Act, specifically concerning the way in which local authorities interact with the utility companies that have a statutory right to dig up the roads, have become mired in controversy.
